HALF-COURT BASKETBALL SHOT CONTEST OFFICIAL RULES
American Campus Communities (“ACC” or “Sponsor”) offers a skills contest at the Moody Center in Austin, Texas, during home games for the University of Texas, Austin (the “Half-Court Basketball Shot Contest”). These Half-Court Basketball Shot Contest Official Rules (“Official Rules”) apply to each of the contests. By participating in a Half-Court Basketball Shot Contest, each contestant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. The terms “you,” “entrant,” and “contestant” refer to each individual selected to participate in a Half-Court Basketball Shot Contest.
EACH HALF-COURT BASKETBALL SHOT CONTEST IS A SKILLS CONTEST. NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO BE AWARDED A PRIZE. A CONTEST WINNER IS A QUALIFYING CONTESTANT WHO SUCCESSFULLY MAKES THE HALF-COURT BASKETBALL SHOT AS DESCRIBED IN THESE OFFICIAL RULES.

1. CONTEST TIME AND LOCATION: Half-Court Basketball Shot Contests are held during University of Texas, Austin home basketball games at the Moody Center in Austin, Texas. No more than one Half-Court Basketball Shot Contest is held per game.
2. ELIGIBILITY: An individuals must be present at the basketball game in order to be selected for an opportunity to complete the half-court basketball shot as part of the Half-Court Basketball Shot Contest, and must complete an ACC guest card when the individual passes the ACC table on the way to the individual’s seat in the student section. Each contestant must be a student enrolled at University of Texas, Austin, in Austin, Texas, at least 18 years of age or older, and a legal resident of the United States. Potential contestants will be selected randomly from the completed ACC guest cards for that game. A potential contestant will be notified by email or text (using the contact information provided on the guest card). If the individual does not accept within 30 minutes, Sponsor may select another potential contestant from the guest cards until Sponsor identifies a student who wants to participate.
Any contestant notification not responded to may result in forfeiture of the opportunity to participate in the Contest.
Each contestant selected to complete the half-court basketball shot in this skills contest agrees to the terms of these Official Rules by participating in the contest; agreement is confirmed by signing below. Additional eligibility requirements for each Half-Court Basketball Shot Contest may be specified in the promotion for that contest during the basketball game.
Unless otherwise specified, the following individuals are NOT eligible:
a. Current or former professional or semi-professional basketball players or coaches who have played or coached at that level anywhere in the world; current or former college or Olympic basketball players or coaches who have played or coached at that level anywhere in the world; current or former high school basketball players or coaches who have played or coached at that level anywhere in the world within the past five (5) years.
b. Sponsor and its direct and indirect subsidiaries and affiliates and each of their respective officers, directors and employees (collectively, the “Promotion Entities”) are ineligible to enter the Contest or win a prize. Household Members and Immediate Family Members of Promotion Entities are also not eligible to enter or win. “Household Members” shall mean those people who share the same residence at least three months a year. “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, domestic partners or spouses.
c. Any individual who was selected to participate in a Half-Court Basketball Shot Contest in the past is not eligible to be selected to participate again. An individual who is selected may not designate someone else to participate on that individual’s behalf.
Sponsor reserves the right at its sole discretion to disqualify individuals who violate these Official Rules, misrepresent themselves, or provide misleading or false information to Sponsor. Entrants agree to be bound by the decisions of Sponsor.
3. PRIZE: There is only one prize per Half-Court Basketball Shot Contest: a $200 (Two Hundred U.S. Dollars) gift card, payable if the contestant successfully completes the half-court basketball shot as specified in these Official Rules. Payment to be made as Sponsor elects, in its sole discretion.
Odds of being selected to attempt the half-court basketball shot depend on the number of eligible contestants. Odds of winning the prize depend upon the contestant’s ability and skill to complete the required half-court basketball shot.
4. CONTESTANT SELECTION: The Sponsor will randomly select a student who has completed an ACC guest card during a University of Texas, Austin, home basketball game at the Moody Center in Austin, Texas, to participate in the Half-Court Basketball Shot Contest for that particular game. The individual must meet the eligibility requirements and agree to these Official Rules.
Final eligibility for the award of any prize is subject to eligibility verification and completion of required forms and/or agreements. Contestant is solely responsible for any expenses that may be incurred in connection with entering or participating in the contest.
5. EQUIPMENT AND THE HALF-COURT BASKET SHOT CONTEST RULES:
The contestant shall not be permitted any practice, warm-up, or qualifying shots or throws, at any time after the contestant is notified of participation in the contest until the actual prize shot(s).
The contestant must successfully throw a regulation basketball from the half-court line (or further back) through the basketball hoop. The contestant may only have one shot and must make the contestant’s first attempt in order to win the prize. No artificial means of tossing the ball may be used in this contest.
Each shot is subject to NCAA Basketball Rules in order to be deemed valid.
No part of the contestant's body, shoes or clothing may come in contact with the half-court line prior to throwing the basketball. Any such contact shall be considered a foul and the attempts shall have been deemed missed.
The Half-Court Basketball Shot Contest must take place on a regulation NCAA regulation size basketball court.
A standard NCAA or NBA men’s basketball league ball of regulation size and weight must be used for this Half-Court Basketball Shot Contest (29.5 inches in circumference). The ball must be inflated to the regulation 7.5-8.5 PSI.
The basketball hoop and backboard shall comply with NCAA or NBA basketball league regulations in effect during the time of the Half-Court Basketball Shot Contest.
Determination of whether the contestant is eligible and satisfied the requirements for the half-court basketball shot is made by Sponsor or its designated representatives, whose decisions are final.
6. CONTESTANT REQUIREMENTS: The contestant must (i) be present to be selected, (ii) agree to comply with the Official Rules, and (iii) sign a copy of these Official Rules. To participate, the contestant must provide proof of his/her/their age, status as a currently-enrolled student, residency and legal status, and sign and return eligibility, publicity and any other releases requested by Sponsor. Sponsor is not responsible for any potential contestant failing to receive notification for any reason, including the potential contestant leaving the contest venue. To obtain the prize, if the contestant successfully completes the half-court basketball shot pursuant to these Official Rules, the contestant must provide Sponsor with all required documents, if any.
7. TAXES/EXPENSES/FORFEITURE: Federal, state and local taxes are the sole responsibility of the winner, and winner is responsible for any reporting obligations. Questions related to taxes, should be directed to your personal tax advisor. As a condition of receiving a prize, the winner will be required to provide Sponsor with a completed W9 form (including Social Security Number) so that Sponsor may issue a Form 1099, and to provide a signed release (including a right of publicity waiver) to the extent permitted by law. Winner may also be required to provide Sponsor with a government issued photo identification. Any expenses incurred in connection with delivery or use of a prize is winner’s sole responsibility. Failure to comply with the Official Rules will result in forfeiture of the prize.
8. PRIVACY: Any personal information supplied by you will be subject to the privacy policy of the Sponsor posted at www.americancampus.com/privacy-policy. By entering a Half-Court Basketball Shot Contest, you grant Sponsor permission to share your email address and any other personally identifiable information with the other Promotion Entities for the purpose of administration and prize fulfillment, including use in a publicly available Winner list. Entrants acknowledge that all aspects of the contest will be video taped.
9. LIMITATION OF LIABILITY: Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate information provided by a contestant, or for any faulty or failed electronic data transmissions or mail delivery; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of any Half-Court Basketball Shot Contest; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of any Half-Court Basketball Shot Contest; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to any entrant’s or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in any Half-Court Basketball Shot Contest or download of any documents related to the Half-Court Basketball Shot Contest (including these Official Rules).
By participating you agree to release and hold harmless Sponsor and its subsidiaries and affiliates and their respective owners, shareholders, members partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “Released Persons”) from any and all liability, illness, injury, death, loss, litigation, claim, causes of action, damage, costs and expenses (including, without limitation, reasonable counsel fees), INCLUDING LOSSES CAUSES BY THE NEGLIGENCE OF SPONSOR OR ANY OF THE RELEASED PERSONS, that may occur, directly or indirectly, and that you may have now and/or in the future, no matter how caused, arising from or in connection with (i) such entrant’s participation in any Half-Court Basketball Shot Contest and/or such entrant’s acceptance, possession, use, or misuse of a prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the selection process or any Half-Court Basketball Shot Contest; (v) disruptions or delays in the delivery of entries; (vi) electronic or human error which may occur in the administration of any Half-Court Basketball Shot Contest or the processing of guest cards; or (vii) any breach or alleged breach by you of any affirmation, undertaking or obligation set forth in any documents or information you provide to Sponsor in connection with any Half-Court Basketball Shot Contest.
If, for any reason, a Half-Court Basketball Shot Contest cannot be run as planned for reasons which include, without limitation, disruptions at the contest venue, restrictions on number of attendees at events, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, the COVID-19 or other pandemic, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Half-Court Basketball Shot Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Half-Court Basketball Shot Contest in whole or in part. In such event, Sponsor shall immediately suspend all contests and prize awards, and Sponsor reserves the right to award the prizes in a manner deemed fair and equitable by Sponsor. Neither Sponsor or any of the Released Persons shall have any liability to any entrant in connection with any Half-Court Basketball Shot Contest. IN NO EVENT SHALL SPONSOR OR RELEASED PERSONS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, INCURRED BY ENTRANT OR ANY THIRD PARTY, WHETHER BASED ON WARRANTY OR IN CONTRACT, TORT, OR OTHER LEGAL THEORY, AND WHETHER OR NOT ADVISED OF THE POSSIBILITIES OF SUCH DAMAGES, ARISING FROM THE CONTEST, PRIZE OR USE OF A PRIZE, EVEN IF SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. SOCIAL NETWORK DISCLAIMER
This promotion is in no way sponsored, endorsed or administered by, or associated with any social media platform, such as Facebook or Instagram or Twitter. You understand that you are providing your information to the Sponsor and not to Facebook or Instagram or Twitter. If you participate via a social medial or other third party platform, you confirm compliance with the policies and terms of such third party platform.
10. PRIZE WINNER LIST/OFFICIAL RULES: To learn the name of the contestant who successfully completed a half-court basketball shot and was awarded a prize, or to obtain a copy of these Official Rules, send your request along with a self-addressed envelope to Sponsor at the address below. Requests for the name of the prize recipient must be received no later than 60 days after the Contest Period has ended.
11. CHOICE OF LAW/DISPUTES/JURISDICTION. This Half-Court Basketball Shot Contest is governed by the laws of Texas, and all entrants agree to personal jurisdiction and venue in Travis County, Texas, for the resolution of all actions, litigation, claims and disputes, and agree that all actions, litigation, claims and disputes shall be brought in a court with competent jurisdiction in Travis County, Texas.
If any provision of these Official Rules is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Official Rules, which shall remain in full force and effect.
Every Half-Court Basketball Shot Contest is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.

10. PRIZE WINNER LIST/OFFICIAL RULES: To learn the name of the contestant who successfully completed a half-court basketball shot and was awarded a prize, or to obtain a copy of these Official Rules, send your request along with a self-addressed envelope to Sponsor at the address below. Requests for the name of the prize recipient must be received no later than 60 days after the Contest Period has ended.
11. CHOICE OF LAW/DISPUTES/JURISDICTION. This Half-Court Basketball Shot Contest is governed by the laws of Texas, and all entrants agree to personal jurisdiction and venue in Travis County, Texas, for the resolution of all actions, litigation, claims and disputes, and agree that all actions, litigation, claims and disputes shall be brought in a court with competent jurisdiction in Travis County, Texas.
If any provision of these Official Rules is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Official Rules, which shall remain in full force and effect.
Every Half-Court Basketball Shot Contest is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.

13. Contestant acknowledges agreement to the Official Rules by participating in the Half-Court Basketball Shot Contest and hereby confirms agreement to these Official Rules.
